Threat or Reality? The Judicialization of Labor Conflict in Chile

Abstract

This article shows how labor conflict in Chile is highly judicialized. This process is explained as the result of a twofold process. On the one hand, the labor policies of the last three decades. On the other, the willingness of workers and unions to fight for their rights by circumventing the restrictions that legislation places on striking. The article also discusses the effects this process has had for workers. Finally, some general recommendations are set out for a possible Labor Reform.
